Hi, I would agree from looking at the photo it doesn't appear to be too serious but you would really need to get it up on a ramp and have a good "prod about" to make sure it's just surface rust and not more serious. Strictly speaking, the MOT tester is restricted to how much they can physically poke around, or remove to check. If you can't do this yourself it may be an idea to have an AA or similar inspection done to give you a bit more peace of mind.
